Blue Ride SXM or the Renter is not responsible for the conditions under which the Renter uses its equipment. The Hirer must be aware of his or her technical and physical abilities to complete the planned routes. Blue Ride SXM draws the Renter's attention in particular to the extent of the real physical effort that the use of navigation equipment may entail, and more particularly in the face of prevailing winds and marine currents.

The use of transparent and electric kayaks and paddles implies a certain mastery of navigation. Blue Ride SXM reserves the right to prohibit the departure of any customer it deems unable to navigate.

2- Booking:

The reservation becomes effective after acceptance of the General Rental Conditions and receipt of the signed rental contract.

3- Cancellation :

Blue Ride SXM reserves the right to cancel a reservation at the event of bad weather or other events that may affect the activity.

4- Terms of payment :

Payment must be made on the day of rental.

5- Rental period :

Hire by the hour: from 9am to 6pm (excluding excursions). The Hirer must respect the agreed rental or excursion time.

Blue Ride SXM cannot, under any circumstances, be held responsible for any damage or accident to persons or property caused by the use of the equipment by the Renter.

The Tenant remains fully responsible for the use of the equipment and any resulting damage. The Tenant also remains entirely responsible for any damage caused to a third party as a result of the use of the equipment in his care.

Blue Ride SXM will not be liable for any damage or accident to persons or property caused by the use of the rented equipment or by the use of third parties.

The hirer is personally liable for any damage to or theft of the paddles, kayaks and accessories, and must insure their replacement costs, from the time they are made available to the time they are returned.

Blue Ride SXM declines all responsibility for stains, snags, loss of clothing or objects, or injuries. It is strictly forbidden to sail more than 300 meters from the coast.

It is strictly forbidden to jump or dive from transparent kayaks and electric paddles.

It is forbidden to litter in the sea or on the course, or to feed fish, turtles or any other marine animal.

The consumption of tobacco, alcohol or any illicit substance during the practice of these activities is dangerous and strictly forbidden. Blue Ride SXM declines all responsibility in the event of an accident. Failure to comply with safety instructions may result in injury or death.

For obvious safety and insurance reasons, it is forbidden for anyone other than those who have booked the rental to board the boats.

Buoyancy jackets and first-aid equipment are provided.

All children under the age of 10 MUST wear a life jacket for the duration of the activity.

The Hirer undertakes, when using the kayaks and stand-up paddle boards, to remain within the authorized zone, i.e. the Bay in which the activity will take place. It is strictly forbidden to navigate beyond the chosen bay, as well as in areas prohibited to the practice of these activities.

Blue Ride SXM will remind the Renter of the boundaries of the authorized zone before the start of the activity. The Hirer must ensure that a safe distance is maintained between boats.

The Hirer undertakes to systematically wear the leash for stand-up paddle boards and the circuit breaker for electric paddles, in order to maintain a link with the boat at all times in the event of a fall.

Wearing a buoyancy aid is strongly recommended when using recreational water sports equipment, and compulsory for children under 12.

In the event of failure to comply with the aforementioned safety instructions, Blue Ride SXM may terminate the rental contract by operation of law. In such a case, no compensation or refund may be requested by the Renter.

The use of kayaks and stand-up paddles must remain within the framework of an activity in the Bay chosen for the practice of the activity. It is strictly forbidden to sail beyond the chosen bay, or in areas prohibited to the practice of these activities.

9- Restrictions on access to the service offered:

Blue Ride SXM cannot welcome people who do not meet the physical and moral conditions required for this type of activity at sea and, in general, any person suffering from a pathology incompatible with this type of activity (refer to your doctor in case of doubt).

10- Special conditions :

Blue Ride SXM cannot be held responsible for early departures (on excursions or rentals) due to cold, rain, humidity, heat or other reasons related to discomfort resulting from weather conditions, among others. Customers should bring appropriate clothing and towels if necessary.

11- Pets :

Pets are not allowed on the boats. Similarly, Blue Ride SXM cannot undertake to supervise the Renter's pets during the activity.

12- Complaints :

Any claim relating to the rental must be sent by registered letter with acknowledgement of receipt within 30 days of the rental to the following address: Blue Ride SXM, 03 rue du Cabestan, park of the bay Orientale , 97150 SAINT-MARTIN.

13- Personal effects brought by the customer:

Blue Ride SXM declines all responsibility in the event of loss, damage or theft of the Renter's personal effects including in vehicles left in the parking lot.

14- Insurance:

Blue Ride SXM recommends the Renter to be covered by a personal liability insurance valid on the day of the rental.

15- Special conditions for group rentals :

In the case of a group rental (2 persons or more), the person making the reservation undertakes to inform the members of said

group of the present General Rental Conditions. These General Rental Conditions apply to all members of the group, who undertake to respect them.

16- Applicable law and jurisdiction:

The contract is governed by French law.

This agreement is drafted in French and English. In the event of any contradiction between the French and English versions of the agreement, the French version shall prevail.

Failing amicable settlement, the following stipulations shall apply:

In the event of any dispute arising from the validity, conclusion, performance or termination of the contract, the Court of Basse Terra shall have exclusive jurisdiction.

If the Tenant or persons associated with the rental prefer not to appear in such images, they are requested to inform the Renter at the time of rental.
